1. Acceptance of Terms

Welcome to FetchValue. By accessing or using the FetchValue mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

These Terms constitute a legally binding agreement between you and Scout Dog AI Studios LLC ("FetchValue," "we," "our," or "us"). Your use of the App is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

You must be at least 13 years old to use FetchValue. By using the App, you represent and warrant that you meet this age requirement.

2. Service Description

FetchValue is an item valuation service that provides estimated market values for personal items based on photos you submit. Our service:

• Item Identification: Uses advanced image recognition to identify items from photos taken with your device's camera or selected from your photo library
• Price Estimation: Provides two-tier pricing estimates (local pickup and online marketplace values) based on condition assessment
• Multi-Condition Analysis: Evaluates items across different condition states (Excellent, Good, Fair, Poor) to give you a complete value range
• Credit System: Operates on a credit-based model where each valuation consumes credits that can be purchased through in-app purchases
• Referral Program: Allows users to earn bonus credits by referring friends ("Give 5, Get 5" program)

FetchValue is designed to help you make informed decisions about selling, insuring, or donating personal items. The service is available on iOS devices through the Apple App Store.

3. User Responsibilities

By using FetchValue, you agree to:

• Accurate Information: Provide accurate and honest information about items you submit for valuation
• Clear Photos: Submit clear, well-lit photos that accurately represent the item and its condition
• Lawful Use: Use the App only for lawful purposes and in accordance with these Terms
• Account Security: Maintain the security of your account credentials and notify us immediately of any unauthorized access
• Prohibited Content: Not submit photos of illegal items, counterfeit goods, weapons, drugs, or other prohibited materials
• No Abuse: Not attempt to manipulate, exploit, or abuse the service, including the referral program or credit system
• Respectful Conduct: Not use the App to harass, abuse, or harm others

You are solely responsible for your conduct and any data, text, images, or other content that you submit through the App. We reserve the right to suspend or terminate accounts that violate these responsibilities.

4. Credit System and Purchases

Credit Consumption

FetchValue uses a credit-based system. Each item valuation consumes credits from your account balance. Credit costs may vary based on the type of valuation requested.

Purchasing Credits

Credits can be purchased through in-app purchases processed by Apple's App Store. Available credit packages and pricing are displayed within the App. All purchases are subject to Apple's terms and conditions for in-app purchases.

Earning Credits

You may earn bonus credits through our referral program by inviting friends to use FetchValue. When a new user signs up using your referral code and completes their first valuation, both you and the new user receive 5 bonus credits.

Non-Refundable

Credits are non-refundable. Once purchased, credits cannot be exchanged for cash or other value. Credits have no cash value and cannot be transferred or sold to other users.

No Expiration

Credits do not expire and remain available in your account as long as your account is active and the service is operational.

Price Changes

We reserve the right to change credit pricing and package offerings at any time. Changes will not affect credits already purchased.

5. Accuracy Disclaimer

FetchValue provides estimated market values based on image analysis, market data, and algorithmic calculations. However:

• Estimates, Not Appraisals: Our valuations are estimates, not professional appraisals. They should not be used for insurance claims, legal proceedings, tax purposes, or other situations requiring certified appraisals
• Market Variations: Actual sale prices may vary significantly based on local market conditions, buyer demand, seasonality, and other factors
• Condition Assessment: Automated condition assessment may not capture all defects, damage, or features that affect value
• No Authentication: We do not authenticate items or verify authenticity. Valuations assume items are genuine
• Data Limitations: Valuations are based on available market data, which may be incomplete or outdated for some items
• User Input: Valuation accuracy depends heavily on the quality of photos and information you provide

Your Use of Valuations

You acknowledge and agree that:

• You use FetchValue valuations at your own risk
• You should conduct additional research before making important financial decisions
• For significant items, you should obtain professional appraisals from certified appraisers
• We are not liable for any losses resulting from reliance on our valuations

6. Intellectual Property

Our Intellectual Property

The FetchValue App, including its design, features, functionality, source code, algorithms, and content, is owned by Scout Dog AI Studios LLC and protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes in accordance with these Terms.

Your Content

You retain ownership of photos and content you submit to FetchValue. By submitting content, you grant us a worldwide, royalty-free license to use, process, and analyze your content solely to provide the valuation service and improve our service.

We do not claim ownership of your photos. Photos are processed and deleted from our servers within 24 hours, as described in our Privacy Policy.

Restrictions

You may not:

• Copy, modify, or create derivative works of the App
• Reverse engineer, decompile, or disassemble the App
• Remove any copyright or proprietary notices
• Use the App to develop competing products or services
• Extract or scrape data from the App using automated tools

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FETCHVALUE AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR:

• Indirect Damages: Any indirect, incidental, special, consequential, or punitive damages
• Lost Profits: Loss of profits, revenue, data, or business opportunities
• Valuation Accuracy: Any losses resulting from inaccurate valuations or reliance on estimated values
• Service Interruptions: Any damages resulting from service unavailability, errors, or interruptions
• Third-Party Services: Actions or failures of third-party services, including Apple App Store, Firebase, or Google Cloud services

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU EXCEED THE AMOUNT YOU PAID TO FETCHVALUE IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We do not warrant that:

• The App will be error-free or uninterrupted
• Defects will be corrected
• The App is free of viruses or harmful components
• Valuations will be accurate or reliable

8. Termination

By You

You may stop using FetchValue at any time by deleting the App from your device. You may request deletion of your account by contacting us at support@scoutdog.ai.

By Us

We reserve the right to suspend or terminate your access to FetchValue at any time, with or without notice, for any reason, including:

• Violation of these Terms
• Fraudulent or abusive behavior
• Non-payment or chargebacks
• Prolonged inactivity
• Legal or regulatory requirements

Effect of Termination

Upon termination:

• Your right to use the App immediately ceases
• Unused credits are forfeited (credits are non-refundable)
• Your account data may be deleted in accordance with our Privacy Policy
• Sections of these Terms that by their nature should survive (including limitations of liability, disclaimers, and dispute resolution) will continue to apply

9. Governing Law and Disputes

Governing Law

These Terms are governed by the laws of the State of California, United States, without regard to its conflict of law provisions.

Dispute Resolution

If you have a dispute with FetchValue, please contact us first at support@scoutdog.ai to attempt to resolve it informally.

Arbitration

Any dispute that cannot be resolved informally shall be resolved through binding arbitration in San Francisco, California, in accordance with the rules of the American Arbitration Association. You agree to waive your right to a jury trial or to participate in a class action lawsuit.

Exceptions

Either party may seek injunctive relief in court to prevent irreparable harm or infringement of intellectual property rights.

10. Changes to Terms

We reserve the right to modify these Terms at any time. If we make material changes, we will notify you by:

• Posting the updated Terms in the App
• Updating the "Last updated" date at the top of this page
• Sending an in-app notification or email (if applicable)

Your continued use of FetchValue after changes to these Terms constitutes acceptance of the updated Terms. If you do not agree to the changes, you must stop using the App.

We encourage you to review these Terms periodically to stay informed of any updates.

11. General Provisions

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and FetchValue regarding the use of the App.

Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.

Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

Assignment

You may not assign or transfer these Terms or your account without our written consent. We may assign our rights and obligations without restriction.

Force Majeure

We are not liable for any failure or delay in performance due to circumstances beyond our reasonable control, including natural disasters, war, terrorism, labor disputes, or internet service failures.
